ARTICLE 1 — PURPOSE AND SCOPE

These general terms and conditions of sale (hereinafter "GTC") apply to all accommodation and services offered by Kasbah Beldy Chic to its guests, whether via the website kasbahbeldychic.com, by telephone, by WhatsApp, or through any other channel of communication.

Any booking made directly with Kasbah Beldy Chic implies the guest's full and complete acceptance of these GTC. Bookings made through a partner platform (Booking.com, Airbnb) are additionally subject to the specific terms of those platforms.

These terms prevail over any other general or particular terms not expressly agreed to by Kasbah Beldy Chic.

ARTICLE 2 — DEFINITIONS

"Establishment": the guesthouse Kasbah Beldy Chic, located at Douar Dar El Ain, Tamesloht, Marrakech region, Morocco.

"Guest": any natural or legal person who has made a booking with Kasbah Beldy Chic and has paid the deposit or the amount due via the secure payment platform, or by any other accepted means.

"Service": any service marketed by Kasbah Beldy Chic, including in particular room accommodation, exclusive use of the entire property (up to 21 people), dining (La Table), wellness and spa services, activities, excursions and private events.

"Platform": the website kasbahbeldychic.com, the Little Hotelier booking engine, as well as any associated secure payment page.

ARTICLE 3 — CONDITIONS OF ADMISSION

The person making the booking must be at least 18 years of age at the time of the order and have the legal capacity to contract.

Children and minors are welcome at the Establishment, under the full responsibility of the accompanying adult duly identified at the time of booking. Children accepted from the age of 5, at the rates in force on our website.

ARTICLE 4 — BOOKING AND FORMATION OF THE CONTRACT

The booking is considered firm and final upon validation of the deposit payment (see Article 6). A confirmation email is sent automatically to the guest at the address provided when placing the order.

The contract is formed between Kasbah Beldy Chic and the guest at the moment the deposit is effectively received. The guest then receives a booking confirmation including the practical information useful for their stay: address and access to the property, arrival arrangements, check-in / check-out times and contacts.

ARTICLE 5 — RATES

The prices of the services are indicated in EUROS (€) on the Platform. Rates are inclusive of all taxes, excluding the tourist tax payable on site.

Tourist tax: a tourist tax, set by the local authorities, is payable per person per night. Its amount is the one in force at the time of the stay.

The rates in force at the time of booking are those applicable to the order.

Kasbah Beldy Chic reserves the right to modify its rates at any time, with no retroactive effect on bookings already confirmed.

Unless otherwise stated, the rates do not include flights, unspecified transfers, personal expenses, travel insurance or gratuities. Breakfast is offered as an extra, per person per day.

ARTICLE 6 — PAYMENT AND DEPOSIT

The terms below apply to room bookings. The specific conditions applicable to exclusive use of the property and to private events are set out in Article 7.5.

A deposit of 45% of the total booking amount is payable at the time of booking. The deposit is paid online via the secure payment platform, by bank card or by PayPal.

The balance, corresponding to the remaining 55%, is payable the day before your arrival.

All payment data is encrypted and processed directly by the payment provider. Kasbah Beldy Chic never has access to the guest's bank card numbers. The security of transactions is ensured by the payment provider.

ARTICLE 7 — CANCELLATION AND REFUND POLICY

7.1 — Booking without cancellation insurance
The booking is non-refundable. In the event of an impediment, a postponement of the stay may be offered subject to availability, upon request sent by email to patrick@kasbahbeldychic.com, the date of receipt of the email being authoritative. No refund may be claimed.

7.2 — Booking with cancellation insurance (SafeBooking)
A guest who has taken out the cancellation insurance offered by our partner SafeBooking may, in the event of a covered claim, be entitled to a refund of their stay in accordance with the specific terms of that insurance contract. The claim is filed directly online with SafeBooking.

For bookings made via Booking.com, Airbnb or any other platform (OTA), cancellation is carried out in accordance with the specific terms of those platforms.

7.3 — Cancellation by Kasbah Beldy Chic
Kasbah Beldy Chic reserves the right to cancel a booking in the event of force majeure or exceptional circumstances making it impossible to accommodate guests. In such a case, the guest will be offered an alternative date or a full refund of the sums paid.

7.4 — Modification of the booking
Any request for modification (change of dates, room or number of people) must be submitted as soon as possible. Modifications are subject to availability and may result in a price adjustment.

7.5 — Exclusive use and events
Exclusive use of the property and the organisation of private events are subject to specific conditions: a deposit of 50% of the total amount, cancellation possible only with the cancellation insurance option, and a security deposit of €1,500 held on a bank card. This security deposit is released only after a complete inspection of the property following your departure.

ARTICLE 8 — GUEST OBLIGATIONS

The guest undertakes to provide accurate and complete information when booking, in particular their identity, contact details, the exact number of people, and any dietary or medical restrictions.

The guest is responsible for the validity of their travel documents (passport, visa where applicable). Kasbah Beldy Chic cannot be held liable in the event of refused entry into Moroccan territory.

The guest undertakes to comply with the Establishment's house rules, to use the premises peacefully and not to exceed the accommodation capacity provided for the booked lodging. They also undertake to comply with the safety instructions during any activities and excursions that may be booked.

ARTICLE 8 BIS — HOUSE AND SAFETY RULES

The guest undertakes to comply with the following rules, which form an integral part of these GTC and are detailed in the Establishment's house rules.

Swimming pool
For everyone's safety, access to and use of the swimming pool are subject to the following rules:
- Diving or jumping into the pool is strictly prohibited.
- Access to the pool is prohibited for children under 12 without the constant supervision of their legal guardian.
- Swimming is undertaken solely at the guests' own risk; no lifeguard is present on the property.
- Guests are asked not to run around the pool and not to bring glass objects into the pool area.
- The pool is accessible only during the hours indicated on site.

Animals on the property
Kasbah Beldy Chic is a living home where several pets reside permanently: a dog, a cat and a tortoise. Guests who are sensitive, allergic or fearful towards animals are invited to inform us before their arrival. Our animals are sociable and used to the presence of visitors; we thank you for contributing to their well-being by not feeding them without our consent.

Alcohol consumption
Kasbah Beldy Chic does not hold a licence to sell alcoholic beverages and therefore does not sell any alcohol. Guests who wish to may bring their own drinks, subject to a corkage fee per bottle, the amount of which will be communicated to you on site. In accordance with Moroccan regulations, you will be asked to provide the purchase receipt for the drinks made out in your name, which the Establishment keeps in order to present it to the local authorities in the event of an inspection.

Compliance with Moroccan law
Kasbah Beldy Chic is required to comply with the Moroccan legislation in force. This legislation regulates the accommodation of unmarried couples who are Moroccan nationals or of Muslim faith. As such, the couples concerned will be asked to present a marriage certificate on arrival. This document, handled in complete confidence, allows the Establishment to meet its legal obligations in the event of an inspection by the local authorities. We thank our guests for their understanding regarding these provisions, which apply to all accommodation establishments in the Kingdom.

ARTICLE 9 — LIABILITY OF KASBAH BELDY CHIC

Kasbah Beldy Chic undertakes to provide the accommodation and services described at the time of booking, with the care expected of a guesthouse.

Kasbah Beldy Chic cannot be held liable for damage resulting from force majeure, from the guest's actions, or from the unforeseeable and insurmountable act of a third party unconnected with the service.

Guests are advised to keep their valuables in a safe place. Kasbah Beldy Chic cannot under any circumstances be held liable in the event of loss or theft. Kasbah Beldy Chic strongly recommends that the guest take out travel insurance covering cancellation, repatriation and civil liability abroad.

ARTICLE 10 — PERSONAL DATA PROTECTION

In accordance with Moroccan Law No. 09-08 on the protection of individuals with regard to the processing of personal data, and with the General Data Protection Regulation (GDPR) for European guests, Kasbah Beldy Chic undertakes to protect the personal data of its guests.

The data collected (surname, first name, email, telephone, country of residence) is used exclusively for processing the booking, sending information relating to the stay and, subject to the guest's consent, sending marketing communications.

The guest has the right to access, rectify, delete and object to the processing of their data. Any request must be sent to patrick@kasbahbeldychic.com. The guest may unsubscribe from marketing communications at any time.

Payment data is processed exclusively by the payment provider and is neither stored nor accessible by Kasbah Beldy Chic.

ARTICLE 11 — INTELLECTUAL PROPERTY

All content on the website kasbahbeldychic.com (texts, photographs, logos, videos, graphic identity) is the exclusive property of Kasbah Beldy Chic or its partners. Any reproduction, even partial, is prohibited without prior written authorisation.

ARTICLE 12 — COMPLAINTS

Any complaint relating to a stay must be sent by email to patrick@kasbahbeldychic.com within 30 days following the end of the stay. Kasbah Beldy Chic undertakes to acknowledge receipt within 48 hours and to provide a response within 15 working days.

ARTICLE 13 — GOVERNING LAW AND DISPUTES

These GTC are governed by Moroccan law.

Any dispute relating to their interpretation or performance shall be subject to the exclusive jurisdiction of the courts of Marrakech, Morocco.

In the event of a dispute, the guest and Kasbah Beldy Chic undertake to seek an amicable solution before any legal action.
